The following are the main regulations governing matters relating to the protection of companion animals, their keeping, identification, registration and licensing, with a special regime for dangerous or potentially dangerous animals, as well as regulations concerning the control of rabies and other diseases transmissible to humans. National legislation concerning the protection of the Iberian wolf is also included.

Protection of companion animals

Establishes legal standards, particularly regarding the keeping, housing, care and handling, safety, welfare and transport of companion animals.

Establishes the legal rules aimed at implementing the European Convention for the Protection of Pet Animals in Portugal.

Regulation (EC) No. 998/2003, of May 26, 2003

Regulates the animal health requirements applicable to the non-commercial movement of pet animals and the rules relating to the control of such movement, and amends Council Directive 92/65/EEC.

Law No. 49/2007, of August 31, 2007

Second amendment to Decree-Law No. 276/2001, of October 17.

Ordinance No. 968/2009, of August 26, 2009

Establishes the conditions and technical standards governing the transport of pet animals on public transport, as provided in Decree-Law 276/2001.

Decree-Law No. 260/2012, of December 2012

Carries out the fifth amendment to Decree-Law No. 276/2001, regulating the exercise of the activity of operating accommodation, regardless of its purpose, and the sale of pet animals.

Law No. 69/2014, of August 29, 2014

Criminalises the mistreatment of pet animals and carries out the second amendment to Law No. 92/95, of September 12, on animal protection, broadening the rights of animal welfare associations.

Law No. 110/2015, of August 26, 2015

Establishes the framework of accessory penalties applicable to crimes against pet animals (third amendment to Decree-Law No. 315/2009, of October 29).

Law No. 8/2017, of March 3, 2017

Establishes a legal status for animals, amending the Civil Code, approved by Decree-Law No. 47 344, of November 25, 1966, the Code of Civil Procedure, approved by Law No. 41/2013, of June 26, and the Penal Code, approved by Decree-Law No. 400/82, of September 23.

Identification and registration of dogs and cats

Establish the legal rules for the registration, classification and licensing of dogs and cats, as well as their identification, namely through electronic identification systems.

Approves the Identification and Registration System for Canines and Felines (SICAFE).

Decree-Law No. 314/2003, of December 17, 2003

Establishes the rules relating to the possession, retention, trade, exhibition and entry into national territory of animals susceptible to rabies, in addition to approving the National Programme for the Control and Epidemiological Surveillance of Animal Rabies and Other Zoonoses (PNLVERAZ).

Ordinance No. 421/2004, of April 24, 2004

Approves the Regulation for the Registration, Classification and Licensing of Dogs and Cats.

Notice No. 4730/2007, of March 13, 2007

Determines that the electronic identification of dogs be carried out under the campaign regime, similarly to anti-rabies vaccination.

Decree-Law No. 82/2019, of June 27, 2019

Establishes the rules for the identification of pet animals, creating the Pet Information System (SIAC) (revokes Decree-Law No. 313/2003, of December 17, and Ordinance No. 421/2004 of April 24).

Control of rabies and other zoonoses

Establish the legal rules relating to the possession, retention, trade, and exhibition of animals and their entry into the country within the scope of the programme to control animal rabies and other zoonoses — diseases transmitted to humans.

Approves the technical rules for regulatory implementation of the National Plan for the Control and Epidemiological Surveillance of Animal Rabies and Other Zoonoses (PNLVERAZ).

Decree-Law No. 314/2003, of December 17, 2003

Approves the National Programme for the Control and Epidemiological Surveillance of Animal Rabies and Other Zoonoses (PNLVERAZ) and also establishes the rules relating to the possession, retention, trade, exhibition and entry into national territory of animals susceptible to rabies.

Order No. 6756/2012, of May 18, 2012

Defines the anti-rabies vaccination rates to be applied for campaign-based actions.

Ordinance No. 264/2013, of August 16, 2013

Approves the technical rules for regulatory implementation of PNLVERAZ and establishes measures for the prevention of animal rabies and clinical and epidemiological surveillance, reformulating those approved by Ordinance No. 81/2002.

Order No. 1946/2021, of February 22, 2021

Defines the technical rules for regulatory implementation of the National Programme for the Control and Epidemiological Surveillance of Animal Rabies and Other Zoonoses (PNLVERAZ).

Possession of dangerous animals

Establish the legal regime for the breeding, reproduction and possession of dangerous and potentially dangerous animals as pets, reinforcing the requirements for their possession and the criminal and administrative offence regimes, and define the breeds and crossbreeds that are potentially dangerous.

Law No. 82/2009, of August 21, 2009

Authorises the criminalisation of behaviours corresponding to the promotion of or participation with animals in fights between them, as well as the offence against physical integrity caused by a dangerous or potentially dangerous animal, by intent or negligence of its owner.

Protection of the Iberian wolf

Establish and regulate the foundations for the protection, conservation and promotion of the Iberian wolf.

Law No. 90/88, of August 13, 1988

Iberian wolf protection law, which grants it the status of protected species in Portuguese territory, expressly prohibiting its hunting or capture, as well as the disturbance or destruction of its habitat.

Regulates the application of Law No. 90/88.

Decree-Law No. 54/2016, of August 25, 2016

Develops the principles of protection and conservation of the Iberian wolf enshrined in Law No. 90/88, of August 13 (revokes Decree-Law No. 139/90, of April 27).

Defines the rules for payment of compensation for damage directly caused by the action of the Iberian wolf.

Action Plan for the Conservation of the Iberian Wolf – PACLobo: frames and coordinates the national effort for the conservation of the species in the national territory.
